The intervenors in the case\, the Oregon Shores Conservation Coalition and North Coast Communities for Watershed Protection\, will be represented by the Crag Law Center.

Federal Emergency Management Agency which is the driving factor in Oregon communities moving to update their floodplain management codes. There will be a discussion of why adequate updates are necessary to ensure that local communities\, developers\, the State\, and FEMA comply with federal law as they participate in the National Flood Insurance Program. Also\, there will be talk about how protecting floodplain habitat necessarily allows building more resilient communities that are better able to withstand ever-increasing flooding events.\n\nThis webinar will provide local governments with a background on the history and reasoning for these reforms\, as well as grassroots perspectives on the opportunities and implications posed by each pathway. DESCRIPTION:WHAT: City of Rockaway Beach Public Hearing on Ordinance 2025-05 Amending Zoning Ordinance Related to Flood Hazard Overlay Zone and Public Hearing on Ordinance 2025-06 Amending Comprehensive Plan Related to Flood Hazard Overlay Zone \nWHEN: Wednesday\, November 12\, 2025 – 6:00 P.M. \nWHERE: Rockaway Beach City Hall\, 276 Hwy 101 – Civic Facility \nWHY THIS IS IMPORTANT \nPer the Federal Emergency Management Agency (FEMA)\, all communities that participate in the National Flood Insurance Program (NFIP) are required to implement Pre-Implementation Compliance Measures (PICMs). These PICMs provide communities with the authority to regulate/limit/prevent development in Special Floodplain Hazard Areas (SFHAs). This is a significant opportunity to protect our precious floodplains and wetlands and improve public safety. These measures must assure “no net loss” to one or more key floodplain functions. Three broad options were provided which roughly translate to: \n\nPermit-by-Permit – This is considered to be the least protective of SFHAs\nModel Ordinance – Moderately protective of SFHAs\nProhibit Development – Most protective of SFHAs\n\nIt is important to note that there are active high-level lawsuits that have delayed final direction from FEMA\, but these interim ordinance and comprehensive plan modifications will set the stage for how well a community can protect its SFHAs in the meantime. What the City of Rockaway Beach is proposing to adopt on November 12th\, is the least protective option of Permit-by-Permit. In fact\, the City stated that: “Adoption of the ordinances will ensure compliance with the minimum standards for participation in the NFIP in Oregon” (emphasis added) \nHOW TO PROVIDE PUBLIC COMMENT \n• Written Comments may be submitted electronically by sending an email no later than 48 hours prior to the meeting to CityHall@Corb.us \n• In Person – sign-up sheet and instructions will be located on the table outside of the meeting room \n• Virtually on Zoom – use the “raise hand” feature when the Mayor announces it is time to do so \nPOTENTIAL TALKING POINTS (questions dick.nccwp@gmail.com) \n\nRequest that City does not proceed with the least protective option\nAsk the City to consider prohibiting development in the SFHAs which would:\n\n\nPrevent catastrophic loss to property\nProtect our precious wetlands\nProtect the groundwater wells that are part of our drinking water system\nProtect several species of fish that rely on these areas\nProtect other critical species that rely on these ecosystems\nReduce flooding potential\nDemonstrating “No Net Loss” to a key floodplain function is extremely difficult to accomplish\, regulate\, or monitor.\n\nDetailed information on the City’s proposed ordinance and comprehensive plan modifications can be found at Community Development – City of Rockaway Beach

DESCRIPTION:Here’s information about the appeal of the proposed Nedonna Wave PUD that was filed with the Rockaway Beach City Council.Please help to support the appeal the Oregon Shores Conservation Coalition filed of the RB Planning Commission’s decision to allow the Nedonna Wave Planned Unit Development to go forward. (See attachment.) (Oregon Shores is the appellant and is represented by the Crag Law Center.)\n\n \nAt the September 11th RB City Council meeting\, it was decided to hold a hearing concerning this appeal at the Wednesday\, November 20th City Council meeting. They voted “to limit the presentation of additional evidence on such issues as the reviewing body determines necessary for a proper resolution of the matter.”\n\n \n\nIf possible\, please attend the Rockaway Beach City Council meeting Wednesday\, October 9\, at 6:00 p.m. You could be there in-person or watch it on Zoom. Additionally\, you can submit written comments about the appeal. Any testimony you make will not be part of the official appeal; however\, it will be part of the public record. It is very important to let the City Councilors hear\, in a personal way\, from all of us about our concerns about the Nedonna Wave PUD. Areas of concern may include loss of wetland habitat (the land and the wildlife)\, detriments to water quality and quantity\, and increased housing density. More areas of concern are the safety issues related to higher fire danger\, as well as the lack of adequate neighborhood access for emergency vehicles and egress for residents’ vehicles. It should be noted that the entire Nedonna Beach neighborhood is defined by DEQ as being a “designated groundwater drinking water protected area.” The groundwater wells that the City uses as a secondary drinking water source are located below this neighborhood. Any additional development will have detrimental effects on this DEQ-protected area.\n \nHelp get the word out\, talk with your family and friends\, and write letters to local media sources. We have had a groundswell of support for protecting this area ranging from neighbors to visitors. Educated at the University of Oregon and Harvard\, Mr. Niemi is President of Natural Resource Economics\, Inc. where he specializes in economic-impact analysis to understand the economic importance of natural resources. He has been active on numerous advisory boards\, including the Citizen’s Task Force for Developing a Strategic Plan for the Oregon Dept. of Fish and Wildlife\, and the Technical Advisory Committee on Land Use and Economic Development for the Oregon Department of Land Conservation and Development. \nMr. Niemi’s presentation will broadly explore the economic consequences of the climate crisis before examining the economic importance of maintaining our forested ecosystem.
